Description
with Juvenile Justice (Care and Protection of Children) Act and The Probation of Offenders Act
If we go in history, we find that the Criminal Procedure Supreme Court Act, 1852 was the first consolidation of the Criminal Procedure Law applicable in the Presidency Towns. Then the Criminal Procedure Code of 1860 came up which consolidated the laws which were applicable in provinces. It was followed by the High Court Criminal Procedure Code of 1865 which replaced the Code of 1861, which in its turn was replaced by the Act of 1872. Such consolidation went on and Code of 1882 came into existence, finally that was also replaced by the Criminal Procedure code of 1898. The Criminal Procedure Code of 1898, which existed before the present one applied to whole of British India. It ensured the accused persons for a trial according to deeply established and tested norms which reflected our notions of natural justice. The present Criminal Procedure Code of 1973 intends to simplify the procedure and speed up the trial including investigation. It also assures a fair deal to deprived sections of the society. In view of increasing rate of several kinds of crime, it has been amended by the Criminal Law (Amendment) Act, 2018.
