The rising global temperature has spurred climate change. This phenomenon is rapidly gaining ground as can be witnessed from the growing number of publications on the subject in the national dailies across the globe. The last ten years have been unsettling as what initially started as a mere scientific fact began to dominate the lives of the humans. Its influence is not limited to only the governments across the globe but also the prac- tices of the private entities. The debate and the consequences of climate change have taken center stage over the last 30 years.
At the outset, this book is not about environmental laws since several major publi- cations and research papers already exist in this space. This book is an effort to consol- idate all the legal frameworks, both nationally and internationally, in one publication, which will be of interest to all individuals looking to bring about positive changes on this subject, including policymakers, activists, legal scholars, and practitioners.
This book shall at first explore the phenomenon of climate change and then pro- gress towards exploring and critically analysing the various treaties, protocols, and con- ventions, and finally the common law jurisprudence emerging in various countries on the issue of climate change.
A significant challenge lies in achieving the net-zero emissions and other such ambitious climate goals. That being said, there have been significant technological advancements that aim to provide efficient solutions to the problems at hand. The author intends to explore the viability of a paradigm that would allow for eliminating carbon and other GHG emissions while paving the way for clean energy transition. This would imply a strict scrutiny of the development of climate technology across various national jurisdictions. In doing so, métier consideration needs to be paid to the global efforts towards financing research and development of the mitigating tech- nologies. Though this book focuses on the law and policy of climate change, it would not fully suffice unless both the advancement in climate technology and the climate finance form part of the discussion, discourse, and narration. Therefore, technology and finance have both been dedicated a chapter each in this book.
