Description
Imagine a scenario where disagreement simmers beneath the surface, threatening to erupt. Frustration builds, communication falters, and the prospect of finding common ground seems bleak. This is where mediation steps in, offering a beacon of hope amidst the storm.
Mediation is a voluntary, facilitated process where disputing parties work collaboratively to reach a mutually agreeable outcome. Think of it as a guided conversation, facilitated by a neutral third-party mediator, who helps parties navigate emotional landscapes, identify underlying interests, and explore creative solutions. This handbook is compiled from my notes during the last 15 years of practice as a mediator and trainer. I have tried to explain all the significant and essential ingredients of mediation in a simple language that anybody can understand. I have used chat GPT Al and Microsoft copilot to improve and edit my notes on various subjects. This handbook is intended for students, laymen, lawyers, and mediators. I hope that this handbook will serve as a roadmap to navigate the field of mediation as a dispute resolution mechanism. Worldwide, mediation is gaining traction as the No: 1 dispute resolution method which is litigant friendly. In India, it still needs to go a long way. The Mediation Act 2023 will no doubt act as a game changer in India. But a lot needs to be done to create awareness amongst the general populace about this new dispute resolution process.
