Description
After having pioneered one of the most admired commentaries on the "Law of Evidence", which saw nine editions and innumerable reprintes in a span of 30 years and which found a pride of place in the bookshelves of leading lawyers and academics alike. Dr. V. Krishnamachari has come up with a commentary on the new Act namely "The Bharatiya Sakshya Adhiniyam, 2023".
The first and immediate advantage that this book provides is a comparative table at the beginning of the provisions of the Indian Evidence Act, 1872 and the Bharatiya Sakshya Adhiniyam, 2023. This is very helpful for people who are familiar with the provisions of old Act, as they do not have to do "a google search" to find out the corresponding provisions in the new Act.
Another important value addition that this book gives is the historical background of the very law of evidence and the way evidence was dealth with, in the ancient Hindu period, the Muslim period and then the British period. This is very important in today's context, as the younger generation of lawyers (and of other occupations) do not know (and do not care to know), that there existed an advanced legal system in ancient India. We find the core principles of the law of evidence in the various Smritis such as Yagnyavalka Smriti, the Arthashastra of Kautilya and in the itihasas like Ramayana and Mahabharata. In the Sabha Parva of the Mahabharata, Yudhishtira loses his kingdom, his brothers, his ownself and then Draupadi. Both before and after she is brought to the assembly shamelessly by Duryodhana, Draupadi asks a question as to whether Yudhishtira lost himself first or lost he before losing himself in the game of dice.
