It is with immense pleasure that we present the current edition of the textbook on Bharatiya Nyaya Sanhita, 2023, a landmark legislation that marks a significant shift in the legal framework governing offences in India. This Act consolidates and amends the provisions relating to offences, replacing the Indian Penal Code, 1860. The Bharatiya Nyaya Sanhita represents a modernized, comprehensive and proactive approach to criminal law and justice in India, reflecting the need to address contemporary legal and societal challenges. The Central Government has notified July 1, 2024 as the effective date for the enforcement of the provisions of the Bharatiya Nyaya Sanhita.
The Sanhita has introduced significant changes by re-arranging the chapters, merging of various provisions, adding new offences/provisions and omission of some existing provisions of Indian Penal Code. The Bharatiya Nyaya Sanhita now comprises of 20 chapters and 358 sections.
This classical work provides an in-depth analysis of the provisions of new legislation. Relevant judgments of Supreme Court and High Courts of Erstwhile Indian Penal Code have been discussed under corresponding new provisions of Bharatiya Nyaya Sanhita. This methodology bridges the gap between established legal principles and the new provisions of Sanhita, empowering readers to confidently navigate the new legal landscape.
In this book, a novel approach has been adopted whereby in case laws, cross referencing of new sections of Bharatiya Nyaya Sanhita have been undertaken for the benefit of readers. Another unique feature of this book are the Comparative Tables that have been placed under each provision incorporating the old corresponding sections and legislative changes introduced in the Sanhita, providing a comparative analysis of old and new law. In addition to this, elaborate explanations on newly introduced offences have also been provided.
