Description
Bharatiya Nagarik Suraksha Sanhita is an adjective law of procedure, but some provisions of the Sanhita are in the nature of substantive law. The object BNSS is to control and regulate set up for the investigation and trial of offences, to provide machinery for implementing the substantive criminal law and ensure a fair trial for the accused. The Sanhita provides the machinery for the investigation of crime, apprehension of suspected criminals, collection of evidence, determination of guilt or innocence of the accused person and the determination of punishment of the guilty. Additionally, it also deals with public nuisance, prevention of offenses and maintenance of wife, child and parents. Juvenile justice and probation of offenders are combined with the study of criminal procedure. The Juvenile Justice Act was thus passed to provide care, protection, treatment, development and rehabilitation of neglected or delinquent juveniles and for the settlement of certain matters related to and disposition of delinquent juveniles. The Probation of Offenders Act, 1958 is a piece of legislation which deals with the provisions relating to probation of offenders. The object of the said Act is to prevent the youthful offenders from association with hardened Criminals of mature age.
