Description
In pursuance of persisting demand of our esteemed readers for an updated edition of the existing version of the instant book, we have just 'solved ourselves to publish the required and update edition of the same. The word "arbiter" was originally used as a non-technical designation of a person to whom controversy was referred for decision respective of any law. Arbitration fundamentally is an extra-judicial, method of settlement of disputes by which parties to dispute get the same resolved through the third person called Arbitrator even without having recourse to a Court of Law, Almost all business transactions contain arbitration clauses. Now the alternative dispute redressal methods like arbitration, conciliation, mediation and their hybrids have become a global necessity and the study on its significance is indispendable. In India, the availability of arbitration as a dispute resolution process in action 89 CPC undoubtably endorses its status as an ADR mechanism. Arbitration being a mode of resolution of dispute, by a Judge of the choice of the parties, can be considered to be preferable to that of adjudication of disputes by Court.
