Description
Indian judiciary is overburdened with the mounting arrears of pending cases. Unless urgent steps are taken to reduce the flood of cases, the Indian judiciary will crumble under its own weight; and the people will lose their faith in the justice delivery system. Thus it has become the need of the day to find some other efficacious alternative to the conventional system of administration of justice. It is with this object, law encourages and allows parties to the dispute to settle their disputes or differences through different methods of alternative dispute resolution processes. Now it has been recognised 'arbitration', 'conciliation', 'Lok Adalat', and 'mediation' as the most common and effective alternative to the conventional system of administration of justice through courts.
